A Milwaukee father is currently on life support in the hospital after being transferred from the Milwaukee County Jail, the family told WISN 12 News.

West Allis police say Xavier Kirk, 30, was arrested near 70th and Becher Street around 2:30 a.m. Saturday. Police said it was for an OWI and to resist an officer.

West Allis police told WISN 12 News they completed their booking process and then transported Kirk to the Milwaukee County Jail.

The family said they were never told of the transfer and struggled to find out Kirk’s whereabouts.

According to the Milwaukee County Sheriff’s Office, sheriff’s deputies notice a white substance on Kirk and an abnormality under his clothing during their booking process. The MCSO said Kirk pulled out two packets of a white powdery substance and began licking his hands.

They said it was minutes later that he needed medical attention and was taken to hospital.

Kirk’s sister, Sharkenya Kirk, told 12 News she received a call from hospital staff the next morning.

“We have him here at St Mary’s Hospital, he is currently in intensive care,” they told him. “And I’m like ‘what’s going on? “”

Hospital staff told his family they found traces of cocaine and marijuana in his blood chemistry, but could not say how many.

WISN 12 News asked the sheriff’s office if they had tested the substance in the bags, but could not comment at this time.

“He has a severe brain injury because he has no blood flow to the brain and no oxygen. They said it was irreversible,” his mother Rachel Kirk told 12 News. “I guess he’s going to be like in a vegetative state for the rest of his life. The woman asked me if that’s what he would like to do. I’m like, he’s a fighter and I have strong faith in God. So that’s what I have to continue on.

The family now wants to know exactly how she got there.

“Someone should have found something about him if they had done proper research,” Rachel Kirk said.

12 News reported that Courtney Sisk asked if Kirk had struggled with drug addiction in the past.

“I didn’t know him to do something like that. But I’m not with him 24/7, so you know, you can’t say what your kids won’t do,” said his mother. “But I never knew him to do that.”

The family now wants to see the full body camera and jail video of the incident.

“We’re not making any accusations, we’re not porous, we’re not confrontational, it’s not an accusation to say anything about the police,” her aunt Belinda Edwards said. “This is a plea to ask for help… It could be years before we really know, but my family needs to know.”

WISN 12 News has requested all body cameras and jail videos from West Allis Police and the Sheriff’s Office.

The sheriff’s office denied the request as it is an ongoing investigation.
